Purpose and scope
This policy applies to the tillampa.comwebsite (“the site”), which is operated by Tillampa LLC(“Tillampa,” “we,” “us,” or “our”). The site is a marketing and informational website and hosts only limited user-generated content. If you believe that material accessible on the site infringes a copyright you own or are authorized to act for, you can ask us to remove or disable access to it using the process below.
This policy governs the website only. Our products — MuniStack, the Tillampa widgets, Corp OS, and custom builds — are governed by separate signed agreements (for example, a Master Service Agreement, Order Form, or Data Processing Addendum), not by this policy. For the general rules of the site, see our Terms of Service.
How to submit a DMCA takedown notice
To report material on the site that you believe infringes your copyright, send a written notice to our designated agent (see Designated agent below). To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of the following six elements:
- Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.
- Identification and location of the infringing material.A description of the material you claim is infringing, with enough detail for us to locate it — ideally the exact URL or page on tillampa.com where it appears.
- Your contact information. Your name, mailing address, telephone number, and email address so we can reach you.
- A good-faith-belief statement. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy and authority, under penalty of perjury.A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or are authorized to act on behalf of the owner of the right that is allegedly infringed.
- A signature. Your physical or electronic signature.
Sending the most complete information possible helps us act quickly. If your notice is incomplete, we may not be able to respond, and we may contact you to request the missing items.
Designated agent
Send DMCA notices to Tillampa's designated copyright agent:
- By email: legal@tillampa.com(please put “DMCA Notice” in the subject line)
- By mail: Tillampa LLC, Attn: DMCA Agent, 116 Maple St, Denton, TX 76201, USA
Please note: the contact above is for copyright notices under this policy. Unrelated questions sent to this address may not receive a response.
What happens after we receive a valid notice
When we receive a notice that substantially complies with the requirements above, we may remove or disable access to the material identified in the notice. Where appropriate and where we have the necessary contact details, we will take reasonable steps to notify the person who provided the material that we have done so, so they have the opportunity to submit a counter-notification.
Counter-notification process
If you believe material of yours was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated agent. Under 17 U.S.C. § 512(g), your counter-notification must include substantially all of the following:
- Identification of the removed material. Identification of the material that was removed or disabled, and the location at which it appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information. Your name, mailing address, and telephone number.
- Consent to jurisdiction.A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the judicial district in which Tillampa may be found), and that you will accept service of process from the person who filed the original notice or that person's agent.
- A signature. Your physical or electronic signature.
If we receive a valid counter-notification, we may forward it to the person who submitted the original takedown notice. As the DMCA provides, we may restore the removed material in not less than 10 nor more than 14 business days following receipt of the counter-notification, unless the original complainant first notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
Repeat-infringer policy
Consistent with the DMCA, Tillampa has adopted a policy of terminating, in appropriate circumstances, the access of any user or contributor who is determined to be a repeat infringer. Because the site hosts only limited user-generated content, this most often means removing the offending content and, where applicable, blocking the person responsible from submitting further material.
Misrepresentations
Be careful what you certify. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, by any copyright owner or its authorized licensee, or by us. If you are unsure whether material is actually infringing, consider seeking legal advice before filing a notice or counter-notification.
A note on this site
The tillampa.com website is primarily a marketing and informational site and contains only a small amount of user-generated content (for example, messages you choose to submit through our forms or the support chat). Most of the content on the site is created or licensed by Tillampa. Even so, we provide this policy so that rights holders have a clear, predictable path to raise concerns. This page is provided for general information and is not legal advice.
